John D. Hinesmon III CRIM 270 Assignment #1 9 June 2011 Mapp v. Ohio, 367 U.S. 643 (1961), was a grammatical case that gnarled the quaternate and 1 quaternate Amendments. In May 1957 the Cleveland Ohio Police section received word that a woman named Dollree Mapp was harboring a ephemeral in her house as well as most iniquitous betting equipment may be rear at her house. A couple officers stayed at the residents while the others went affirm to obtain a search warrant. Ms Mapp took the piece of paper from one of the officers that it was wrestled away from her and she was detained for surreptitious conduct. The police of ficers continue the search and found no fugitive or illegal betting equipment. The officers did stick a cut with some pornographic material in it. Ms Mapp verbalise that she was unaware of the contents in it and/or where it came from. She was arrested, charged, found guilty, and sentenced for possession of the pornographic material.

Ms Mapps lawyer appealed to the Ohio Court of Appeals and autocratic Court of Ohio that the evidence against her was from the result of an illegal and warrantless search. Both appeals were denied. She only appealed to the Supreme Court of the United States. The case was ov erturned by the United States Supreme Courts! stating that the exclusionary rule go out carry out to states as well. Therefore, the evidence illegally gained shouldnt turn in been used against her. The exclusionary rule is protected by both the 4th and 14th Amendments. In this case it was to her advantage because there neer was a search warrant and the materials could have legitimately been unexhausted behind by a prior tenant and/ or just wasnt hers.
